Fern Terms of Service

Last updated: October 24, 2026

These terms cover your use of the Fern desktop app and the sync service that goes with it. They are provided by Steven Caster (“we”). By installing or using Fern you agree to these terms. If you do not agree, do not use Fern. These terms are a plain-language draft and are not legal advice.

What Fern is

Fern is a songwriting notebook for Windows. You need a Fern account to use it. Once you are signed in, your library and recordings sync by default through a hosted service. How data is handled is described in the Privacy Policy.

Software licence

We grant you a personal, non-exclusive, non-transferable licence to install and use Fern on your own devices. Do not sell, rent or redistribute Fern, and do not reverse engineer, decompile or disassemble it, except where the law gives you that right regardless of this limit. We keep all rights we have not expressly granted. Some third-party components and data included in Fern remain under their own licences.

Your content

You own your songs, lyrics, notes, recordings and everything else you put into Fern. We do not claim ownership of any of it.

To make sync work, you give us permission to store, copy and transmit your content on the hosted service, only as needed to run Fern for you (for example syncing it to your other devices and keeping your uploaded recordings). This permission ends when your content is deleted from the service or removed as described in the Privacy Policy.

You are responsible for having the right to use anything you add, including audio files and links.

Accounts

You need an account to use Fern. Whether new accounts can be created at any given time is up to us, and we may limit or close sign-ups. Keep your sign-in details safe; you are responsible for activity under your account. You must be at least 13 years old to create an account or use Fern. Give us accurate information.

Acceptable use

Do not use Fern or the sync service to: break the law or infringe someone else’s rights; upload content you have no right to store; attack, overload, probe or try to break into the service or other people’s accounts; try to read or change another user’s data; or use the service in a way that is meant to harm it or others.

Links to Google Drive or SoundCloud are subject to those services’ own terms.

Updates

Fern checks for new versions and can install them when you choose to. We may change, add or remove features, and we may release updates that are required for sync to keep working with the service.

Third-party services

Fern relies on third parties: Supabase (sync, sign-in, storage), GitHub (releases and updates), Google (optional sign-in and Drive links), SoundCloud (optional links) and Hugging Face (optional model downloads). We do not control them and are not responsible for their availability or terms.

No warranty

Fern is provided “as is” and “as available”, without warranties of any kind, to the extent the law allows. We do not promise that Fern or the sync service will be uninterrupted, error free, or that your data will never be lost. Keep your own backups of work that matters.

Limit of liability

To the extent the law allows, we are not liable for indirect or consequential losses, lost data, or lost profits arising from your use of Fern.

Ending your use

You can stop using Fern at any time by uninstalling it. We may suspend or end an account that breaks these terms or puts the service or others at risk. We may also end the sync service with at least 30 days’ notice. Because Fern needs an account to sign in, ending the service may stop Fern from working for you. Your local library and recordings are files on your computer and stay yours, even if the service ends. To ask for your account and cloud data to be deleted, email stevenuocaster@gmail.com; we will complete the deletion within 30 days of your request. See the Privacy Policy for what can be deleted today.

Changes to these terms

We may update these terms. Changes take effect on the “Last updated” date. We will announce material changes by updating the “Last updated” date and adding a note to the release notes on the Fern releases page on GitHub. Continuing to use Fern after a change means you accept it.

Governing law

These terms are governed by the laws of the State of Oregon, USA.
